Terms and Conditions for the Dirk Kuyt Foundation Charity Initiative

(hereinafter “Terms and Conditions”)

 

Thank you for your interest in the TAF’s Dirk Kuyt Foundation Charity Initiative (hereinafter the “Initiative”) organized by TAF Global Operations B.V. with its business address located at Van Diemenstraat 186, 1013 CP Amsterdam, The Netherlands, being part of TAF EMEA (hereinafter the “Organizing Company”, “We” or “Us”), with collaboration of adidas and the Dirk Kuyt Foundation, Airportplein 55, 3045 AP Rotterdam, The Netherlands (“DKF”).

 

Please read these Terms and Conditions (which include data privacy information as well) carefully. They provide information on the Initiative. By participating in the Initiative, you unconditionally accept and agree to these Terms and Conditions.

 

Please note that the Initiative is in no way sponsored, endorsed or administered by, or associated with, Instagram. By participating in the Initiative, each Participant is completely releasing afore stated social media of any obligations or liability in relation to the Initiative.

 

Running of the Initiative is organized and held exclusively by the Organizing Company. Whilst TAF is an official adidas partner, adidas is not an organizer of the Initiative. Once the collected funds through the initiative are provided to the DKF, the latter resumes all obligations and liability in relation to use and distribution of such funds.

 

Article 1

(Initiative)

The Organizing Company, being conscious of its corporate social responsibility, wishes to make a donation to DKF in the amount as may be determined between the parties (“Maximum Donation”).

During the Term of the Initiative, the Organizing Company shall donate money (until exhaustion of the Maximum Donation) to the DKF upon purchase of any adidas product in the Netherlands (online and offline) from the Organizing Company and its official TAF franchisees (“Purchase”), in the manner that 1 EUR (until exhaustion of the Maximum Donation) shall be donated to the DKF for each purchased product within the Purchase.

 

Article 2

(Term)

The Initiative shall be held from 1 September 2023 to 18 September 2023 or until the Maximum Donation is exhausted, whichever occurs first.

The days indicated in these Terms and Conditions are those of the time zone CET.

 

Article 2

(Conditions)

By the Purchase you agree that part of the proceeds from the Purchase are donated to the DKF.

Initiative is available to Participants purchasing adidas products Organizing Company and its official TAF franchisees – through online store(s) and brick & mortar stores – in The Netherlands. All TAF stores in The Netherlands are participating in this initiative.

Participation in the Initiative implies the express and unreserved acceptance of these Terms and Conditions in all its stipulations as well as the laws and regulations applicable to the Initiative.

The Initiative is open to all individuals who (i) have reached the age of 15 (in case of a minor, a permission from a legal guardian must be obtained for the purchase).

Article 6

(Liability)

The Organizing Company shall not incur any liability whatsoever in the event of force majeure or other similar events which are beyond their control (including but not limited to technical problems, losses or delay in services), interfering with the organization and management of the Initiative.

If exceptional circumstances require, the Organizing Company reserves the right to postpone, shorten, extend, modify, cancel or suspend the Initiative and the liability of the Organizing Company cannot be sought as a result.

 

Article 7

(Amendment of Terms and Conditions)

The Organizing Company may be required to amend these Terms and Conditions to comply with any new legislation and/or applicable regulations.

In the event that any clause hereunder is declared null or void, it shall have no impact on the validity of the remaining part of the Terms and Conditions.

 

Article 9

(Governing law and jurisdiction)

These Terms and Conditions shall be governed by Slovenian law. However, if your usual place of residence is in another European, EU or EEA country mandatory national consumer protection laws of such country will remain unaffected and will continue to apply.

Courts in Ljubljana, Slovenia, shall have jurisdiction in respect of any dispute, which may arise, or the competent court of Participant’s residence.
